1. Acceptance of Terms

By accessing or using rendevo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

rendevo is an AI-powered scheduling assistant that automates appointment bookings through messaging platforms including WhatsApp, Messenger, and Instagram. The Service includes:

• AI-powered conversation management
• Booking and appointment scheduling
• Calendar integration and management
• Team member coordination
• Client communication tools
• Analytics and reporting features
• Optional AI performance feedback and improvement tools

AI Feedback and Consent

Our AI assistant can learn and improve through optional feedback mechanisms:

• Business Owner AI Feedback: When enabled, we analyze your AI assistant's performance to provide personalized recommendations for improving response quality and identifying knowledge gaps. This data remains private to your account.
• Contribute to rendevo Improvements: Separately, you may opt in to share anonymized, aggregated usage patterns to help improve rendevo for the entire community. This includes only non-identifying metrics such as business type categories and common conversation patterns, never customer data or identifying business information.

Both options are disabled by default and can be controlled independently in your AI Assistant settings. See our Privacy Policy for detailed information on how this data is handled.

Cookie Usage and Analytics

rendevo uses only the cookies and browser storage the Service needs to work, such as keeping you signed in and remembering your language. We do not use advertising or analytics cookies and do not show a cookie consent banner. In the app (outside the public booking pages) and on our public website, we count page views with cookieless, aggregated visit statistics (Vercel Web Analytics). 3. Account Registration and Security

Account Requirements

To use our Service, you must:

• Provide accurate and complete registration information
• Be at least 18 years of age
• Have the legal authority to enter into these Terms
• Maintain the security of your account credentials

Account Security

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breaches.

4. Subscription Plans

We offer the following subscription plans:

• Free Plan: $0 - Basic features with usage limits
• Solo Plan: $19 per month (or $15.83/month billed annually)
• Growth Plan: $49 per month (or $40.83/month billed annually)
• Business Plan: $99 per month (or $82.50/month billed annually)

Billing and Payment

• Subscriptions are billed in advance on a monthly or annual basis
• Payments are processed securely through our third-party payment provider
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days' notice

All paid subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current rate unless cancelled before the renewal date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.

Add-On Purchases

In addition to your subscription plan, you can purchase add-ons to extend your usage limits:

Booking Pack Add-ons:

• 50 AI bookings: $10
• Additional booking packs can be purchased as needed to extend your monthly limit

Location Add-ons:

• Additional location: $10/month per location

Team Member Add-ons:

• Additional team member: $5/month per team member

Add-On Terms:

• Booking packs expire at the end of your current billing period or after 90 days, whichever comes first
• Location and team member add-ons are billed monthly and can be cancelled at any time
• Add-ons are non-refundable once purchased
• Unused booking packs do not roll over to the next billing period
• Add-on pricing may change with 30 days' notice

Online Payments

rendevo enables you to collect online payments from your customers for bookings and invoices through Stripe Connect. By using this feature:

• Payments are processed securely through Stripe
• Standard Stripe processing fees apply and are deducted automatically from each transaction. See Stripe Pricing for current rates.
• Platform fee: A 0.5% fee is applied to each payout to cover payment infrastructure costs
• You are responsible for handling customer refunds and payment disputes
• Funds are deposited to your connected Stripe account according to Stripe's payout schedule

5. Usage Limits and Fair Use

Each subscription tier includes specific limits on features such as locations, team members, contacts, and AI booking conversations. These limits are clearly displayed in your account dashboard and on our pricing page.

Solo Plan:

• AI Bookings: 50 per month
• Locations: 1

• Contacts: Unlimited
• Integrations: WhatsApp, Google Calendar
• Booking Links: 1

Growth Plan:

• AI Bookings: 150 per month
• Locations: 2
• Team Members: 5
• Contacts: Unlimited
• Integrations: WhatsApp, Messenger, Instagram, Google Calendar
• Booking Links: Unlimited

Business Plan:

• AI Bookings: 400 per month
• Locations: 5
• Team Members: 10
• Contacts: Unlimited
• Integrations: WhatsApp, Messenger, Instagram, Google Calendar
• Booking Links: Unlimited

Fair Use Policy

If you exceed your plan's limits:

• We will notify you when you approach your limit
• AI functionality may be paused until you upgrade or wait for the next billing cycle
• You can manually handle conversations through the inbox
• We do not charge overage fees

You agree to use the Service in a fair and reasonable manner. Abuse of the Service, including excessive API calls or attempts to circumvent usage limits, may result in account suspension or termination.

6. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam, unsolicited messages, or engage in harassment
• Impersonate others or provide false information
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to our systems
• Use the Service for illegal or fraudulent purposes
• Reverse engineer or attempt to extract source code
• Remove or alter any proprietary notices or labels

7. Data Ownership, Protection & GDPR Compliance

Your Data Ownership

You retain all rights, title, and interest in the data you input into the Service, including:

• Client contact information and personal data
• Appointment and booking data
• Business information and settings
• Conversation histories (encrypted)
• All content you create or upload

Data Protection Commitments

We are committed to protecting your data through:

• Server-Side Encryption: All customer conversations are encrypted at rest using AES-256-GCM with user-specific encryption keys, providing strong data isolation between accounts.
• PCI DSS Compliant Payments: All payment processing is handled by Stripe, a PCI DSS Level 1 certified payment processor. We do not store, process, or have access to your full credit card numbers.
• Automated Data Deletion: Old data is automatically deleted according to GDPR-compliant retention policies (messages after 30 days, appointments after 2 years).
• Data Minimization: We collect and retain only data necessary to provide the Service.
• Privacy by Design: All features are built with privacy and security as core principles.

Your GDPR Rights

You have the right to:

• Access Your Data: Export all your data instantly through account settings
• Rectify Your Data: Update or correct your information at any time
• Delete Your Data: Request complete account deletion with 30-day grace period
• Port Your Data: Download your data in machine-readable JSON format
• Manage Consent: Control all consents independently (marketing, data sharing, AI feedback)
• Object to Processing: Opt out of non-essential data processing

Our Use of Data

We use your data only to:

• Provide and operate the Service as described
• Process bookings and manage appointments
• Provide customer support and respond to inquiries
• Improve AI performance (only with your explicit consent)
• Send essential service notifications
• Comply with legal obligations

We will never sell your personal data. We may use aggregated, fully anonymized data for analytics and service improvement, but only if you opt in to data sharing consent.

Your Responsibility for Customer Data Deletion Requests

As a business owner using rendevo, you are the Data Controller for your customers' personal data. This means you have legal responsibilities under GDPR to handle data deletion requests from your customers (end-users who book appointments with you).

Your obligations:

• Respond to customer deletion requests within 30 days of receipt
• Verify the identity of customers making deletion requests
• Use rendevo's contact deletion feature to remove customer data
• Maintain your own privacy policy informing customers of their rights
• Keep records of deletion requests for compliance purposes

Tools we provide:

• Contact deletion feature in your dashboard (permanently removes customer data)
• Audit logs of all data deletion actions
• Support for processing deletion requests forwarded by customers to privacy@rendevo.app

Data Export & Deletion

• Instant Export: Export all your data at any time through Personal Settings → Export Your Data
• Complete Export: Includes all messages (decrypted), appointments, contacts, settings, and AI feedback
• 30-Day Deletion Grace Period: Upon account deletion request, you have 30 days to cancel before permanent deletion
• Automatic Pre-Deletion Export: We automatically generate a complete data export before account deletion
• Irreversible Deletion: After 30 days, all personal data is permanently and irreversibly deleted

8. Service Availability and Modifications

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted or error-free operation
• Specific uptime percentages
• That the Service will meet all your requirements
• Complete accuracy of AI-generated responses

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

9. Cancellation and Termination

Cancellation by You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.

Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay fees when due
• Engage in fraudulent or illegal activity
• Pose a security risk to the Service or other users

Inactive Accounts

Business accounts inactive for 90 consecutive days may be deleted, with prior email notice sent to the account owner before any deletion takes effect.

10. Intellectual Property

The Service, including all software, designs, text, graphics, and other content, is owned by rendevo and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary content
• Use our trademarks without permission
• Create derivative works based on our Service

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for AI errors, missed appointments, or business losses
• You use the Service at your own risk

12. Indemnification

You agree to indemnify and hold harmless rendevo from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your data or content

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

• Informal negotiation first
• Binding arbitration if negotiation fails
• Courts in the State of New Jersey, USA, if arbitration is not applicable

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Updating the Last Updated date at the top of this document and notifying users via email constitutes a new version of these Terms, and your continued use of the Service following that notification constitutes your acceptance of that new version.

16. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and rendevo
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Failure to enforce any provision does not constitute a waiver
• Assignment: You may not assign these Terms without our consent
• Force Majeure: Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemic, government actions, power failures, internet disruptions, or third-party service outages.
